Joel Androphy, Sarah Frazier and Ashley Gargour won exoneration of a U.S. executive accused of Foreign Corrupt Practices Act (FCPA) violations and a cover-up of payments made to officials of a Mexican state-owned electric utility after a jury trial in Houston federal court. U.S. District Judge Lynn N. Hughes granted a defense motion for acquittal of John O’Shea, the former general manager of Sugar Land, Texas-based ABB Inc., finding Mr. O’Shea not guilty of all substantive FCPA charges. American Grocers, Inc. and its owner have agreed to pay a settlement amount that nets the whistleblower and government about $13.7 million to resolve civil charges for engaging in false or fraudulent conduct by shipping food products past or near their expiration dates to United States troops stationed in the Middle East. The settlement was reached more than five years after Delma Pallares filed a lawsuit against American Grocers, Inc., alleging the illegal conduct. More Info.

On the civil side, we have represented Fortune 100 and 500 corporations, their board members and executives, as both plaintiffs and defendants, in everything from ordinary contract disputes to bet-the-company litigation. Our firm has a significant nationwide qui tam practice, representing whistleblowers inside corporations that have exposed fraud against the federal and state governments.

On the criminal side, our early practice in state court cases evolved over the years into representation of individuals and corporations in federal court accused of white collar crimes.

Since 1980, David Berg has published more than a hundred legal and political essays and articles in periodicals such as the New York Times, Los Angeles Times, Newsweek and the Houston Chronicle. He frequently demonstrates trial skills for such organizations as the Corporate Counsel Institute, the American Bar Association, the Litigation Section of the ABA, and the Association of General Counsel and was recently named one of the Best Lawyers in America in nine trial specialties. His book, THE TRIAL LAWYER: WHAT IT TAKES TO WIN (ABA 2003), is frequently the #1 bestseller on litigation on Amazon.com.

Joel Androphy has published dozens of articles and has participated in more than eighty seminars, lecturing most recently on qui tam litigation for such organizations as the Food and Drug Law Institute and on white collar crime for the American Corporate Counsel Association. He has written several books, White Collar Crime (Thompson/West 2011), one of the leading works on the subject, and more recently, another treatise, entitled the Federal False Claims Act and Qui Tam Litigation (Law Journal Press 2010).
